Superior Court of Justice defines requirements for the adoption of atypical enforcement measures
On December 4, 2025, the Second Panel of the Superior Court of Justice concluded the judgment of Repetitive Theme 1,137, establishing guidelines for the application of atypical enforcement measures in civil executions, such as the suspension of driver’s licenses, seizure of passports, and blocking of credit cards.
The decision consolidates criteria that guide judges and strengthens legal certainty in the use of these instruments, expanding the possibilities for effective enforcement, provided that the debtor’s guarantees are respected.
